General Terms and Conditions for FotoboxSuite software and portal
Last updated: 8 June 2026
1. Scope
These General Terms and Conditions apply to the use of FotoboxSuite, including the Windows app, customer portal, device management, event management, layout and printing functions, online galleries, invoice area, support and update channel.
2. Provider and contracting party
The provider and contracting party is Patrick Loewe, Völkerhausen 16, 31860 Emmerthal, email: info@fotoboxsuite.de.
3. Customers and trial access
FotoboxSuite is primarily intended for businesses, photo booth rental companies, event service providers and other commercial users. New accounts receive the complete Business features without watermarks for 30 days, for up to 10 devices. Access then ends unless you book a plan. No automatic subscription is created. Use by consumers is permitted only where expressly agreed in an individual case.
4. Formation of the contract
A contract is formed when a paid plan is booked through the payment page, an individual offer is accepted, access is activated or another agreement concerning the use of FotoboxSuite is made. Website descriptions, enquiry forms and demo content do not themselves constitute a binding offer.
5. Scope of services
The specific scope of services depends on the booked plan, the individually agreed offer, access activation, technical provision and the software's current stage of development. Functions may include local app functions, account synchronisation, device management, event management, online galleries, invoices, support and update information.
6. Fees
Fees are determined by the offer shown on the pricing page or individually agreed. Terms, billing intervals, trial conditions and payment arrangements follow the selected plan, payment page, payment management or individual agreement.
7. Customer accounts and credentials
The customer must keep credentials confidential, use secure passwords and report unauthorised access without undue delay. Actions through a customer account are deemed to have been initiated by the customer to the extent that the customer is responsible for the access.
8. Customer obligations
The customer is responsible for the lawful use of FotoboxSuite, particularly regarding photography, event data, guest information, consent, privacy notices, copyright, trademarks, personal rights and permissible content. FotoboxSuite must not be used for unlawful, abusive or security-compromising purposes.
9. Online galleries, uploads and event data
Online galleries may be accessible through public or hard-to-guess links. The customer decides event names, sharing permissions, sharing PINs, retention periods and uploads. The customer ensures that only content for which the necessary rights and data protection grounds exist is uploaded and shared.
10. Rights to use the software
For the agreed period of use, the customer receives a simple, non-exclusive, non-transferable right to use the provided software within the agreed scope. Distribution, sublicensing, decompilation or modification is permitted only where mandatorily allowed by law or expressly agreed.
11. Updates and further development
Updates may include bug fixes, security fixes, functional changes or compatibility adjustments. An entitlement to specific new functions exists only if expressly agreed.
12. Availability
Uninterrupted availability of the website, portal, API, online galleries and update channel is not owed unless an express availability agreement exists. Maintenance, security measures, disruptions, force majeure or third-party services may temporarily affect availability.
13. Invoices and payment
Invoices may be provided through the customer portal, payment management or email. Unless otherwise agreed, payments are due without deductions.
14. Term and termination
The term and termination follow the selected plan, payment management or individual agreement. The right to extraordinary termination for good cause remains unaffected.
15. Restrictions in the event of misuse or late payment
Access may be temporarily restricted or suspended in the event of significant contractual breaches, unlawful use, security risks or late payment. Statutory rights remain unaffected.
16. Defects and support
Statutory rights relating to defects apply. For business customers, Patrick Loewe is initially entitled to remedy defects. The customer should describe identified problems as clearly as possible to enable troubleshooting. Support services follow the individual agreement.
17. Liability
Patrick Loewe has unlimited liability for intent and gross negligence, for injury to life, body or health, and under mandatory statutory liability provisions. In cases of slight negligence, Patrick Loewe is liable only for breaches of essential contractual obligations and only for foreseeable damage typical of the contract. A guarantee is provided only if expressly declared.
18. Backups
The customer is responsible for appropriate local backups of photos, layouts, event data and other content, unless these have expressly been agreed as permanently server-stored services.
19. Data protection and processing on behalf of the customer
Data processing is governed by the privacy policy. Where Patrick Loewe processes personal data on behalf of the customer, the provided Data Processing Agreement also applies.
20. Changes
Changes to these General Terms and Conditions may become necessary if functions, legal requirements or business processes change. Significant changes will be communicated appropriately.
21. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For business customers, the place of business of Patrick Loewe is the place of jurisdiction to the extent permitted. If individual provisions are invalid, the remaining provisions remain valid.
22. Consumer dispute resolution
Patrick Loewe is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body, unless a statutory obligation applies in an individual case.
